What is the subclass 309/100 visa? The subclass 309/100 visa is designed for partners and spouses of Australian citizens, permanent residents, and eligible New Zealand citizens. It is an offshore visa, meaning you must be outside Australia when applying and when it is granted. If you happen to be in Australia on a visitor visa, the Case Officer will inform you when your 309 partner visa is ready to be granted, and you can temporarily depart Australia for the visa to be issued. However, for the second part (100 visa), you can be in Australia when it is granted. Eligibility for Subclass 309 Visa: To be eligible for the Subclass 309 visa, you must meet the following criteria: - Be outside of Australia at the time of application and decision. - Be married to your partner or prove that you have lived together for at least 12 months before applying. - Provide evidence of ongoing financial commitment, shared living arrangements (if in a de facto relationship), and social recognition of your relationship. - Both you and your partner must be over 18 years of age. - Meet the health and character requirements associated with this visa type. - Have no outstanding debts to the Australian Government. Subclass 100 Visa Criteria: When the time comes to apply for the second stage Subclass 100 visa, you must meet the following criteria: - Hold a Subclass 309 offshore partner visa. - Continue to be in a committed and ongoing relationship with your partner, unless special circumstances apply. - Comply with all laws and visa conditions while on your Subclass 309 visa.
